This Privacy Policy gives you an overview on how Bohesse processes your data and, as listed below, applies to Bohesse.com.
By accessing and/or using this Site, you consent to this Privacy Policy outlined below.
Who we are
Our website address is: https://bohesse.com.
Which services and offers does this Privacy Policy apply to
Bohesse processes your data in a similar way for most services. This Privacy Policy applies to all benefits and services we offer to all our customers and/or Site users and visitors, especially citizens of the European Union. This statement is true, regardless whether we do this via this Site, an app, in transactions, over the social media platforms or other communication channels.
For ease of comprehension, the term “services” summarizes this “normal case”.
Bohesse.com has designed this Privacy Policy to help you understand:
If you have any questions regarding this Privacy Policy, whether in whole or by section(s), you can contact us any time by writing to: info AT bohesse.com or filling out our contact form.
1. Which personal data does Bohesse process?
2. What does Bohesse use my data for?
2.1 Purchase processing and provision of online and personalized Services
Bohesse processes your personal data only in the necessary scope needed to fulfill contract and/or to provide and execute further and/or additional Services requested by you, as described in this Privacy Policy.
In the same manner, purposes of these necessary data processing depend on the purpose of the contract agreed with you (including our Terms and Conditions, and/or any service-specific terms and conditions or terms of use) or Services requested by you.
The most important purposes are:
– The provision, customization and needs-based design of our Services, such as this Site and our blog articles.
– The execution of purchase agreements and customer services, including dispatch and payment processing, claim management, processing of returns, complaints and warranty claims.
– The provision of messages, reports, newsletters and other forms of direct communication, as these are an integral component of our contractual Services or Services requested by you.
– The guarantee of general security, operability and stability of our Services.
– Non-promotional communication with you on technical, security-related and contractually relevant subjects. For example, fraud warnings, account blocking, etc.
Legal basis:
As the purpose relates to the execution of a contract agreed with you or the provision of a service requested by you, the legal basis is Article 6 (1) b GDPR. Otherwise, the legal basis is Article 6 (1) f GDPR, whereby we are allowed to use your personal data for the above purposes if we deem it is necessary to do so for our legitimate interests.
2.2 Shopping Customization
Bohesse processes your data in order to provide you with comfortable and useful services that possibly correspond to your needs and interests.
Because we are interested in providing you with the best possible online and shopping experience, we present our content and offers in a needs-based manner. This means that we aim for you to easily find products you are actually interested in. Such shopping customization requires a user-specific evaluation of product and content relevance.
In order to personalize shopping in our Bohesse shop, we use device and access data which we collect for usage analysis.
If you are logged in with your customer account while accessing and using this Site, we also use profile data, interest data and shopping data to customize your shopping experience. This form of shopping customization is also known as on-site optimization. Only such form of shopping customization allows us to present you with suitable search results, product suggestions, style recommendations, as well as other content that corresponds to your actual interests.
Without shopping customization as such, and as carried out by worldwide online shops as standard, your search for relevant products would be less convenient. Of course, shopping customization doesn’t interfere with your browsing and doesn’t prevent you from accessing all available content on this Site. Customized shopping only serves to show you what is possibly more relevant to your needs quickly.
Legal basis:
The legal basis for the processing of your personal data for shopping customization within the frameworks of personalized services is Article 6 (1) b GDPR.
Legal basis for processing of your data within the framework of on-site optimization is Article 6 (1) f GDPR, whereby our legitimate interests are in the above purposes.
2.3 Research
Bohesse processes data collected on our customers for scientific research, but only in scientific areas relevant to Bohesse.
Research at Bohesse concentrates on solutions to real and everyday online shopping issues and experience. Our research is meant to improve and further develop our existing services range.
Our research is based only on summarized and anonymized data usage.
Research at Bohesse includes following purposes:
– Prognoses and analysis of our customers and users’ needs and interests.
– Development of technical solutions for real customer issues. For instance, reducing the probability of wrong buys, sizing, etc.
– Development of technical solutions for optimized business and logistic processes.
Legal basis:
The legal basis for the processing of customer data within the framework of research purposes described above is Article 6 (1) f GDPR, whereby our legitimate interests are in the above purposes.
2.4 Fraud Prevention
In order to combat the risk of possible data security breaches, data pertaining to users of Bohesse Services is encrypted in transmission.
This applies both to ordering products from our store, as well as to registering for a customer account. For these purposes we use the coding system SSL (Secure Socket Layer).
Encryption prevents third parties from viewing the data. Also, in order to provide additional protection from external threats, we rely on special security technologies. These technologies constantly check our systems, identify and report all (if any) anomalies.
In addition, we also use technical and organizational measures to secure our systems against loss, destruction, unauthorized access and/or distribution of customer data by unauthorized persons. Bohesse strives to keep the risk of unauthorized access as low as possible. Protecting your data is our top priority. However, although we have taken all precaution measures, we cannot guarantee absolute protection.
Bohesse also uses technical and manual procedures for fraud prevention with the aim to protect us and all our users from data misuse, especially by fraudulent orders. Bohesse summarizes and evaluates your device and access data (e.g. IP address, user behavior), shopping data and payment details (including address and other creditworthiness data from external credit agencies) under a pseudonym when executing an order. These records are also compared with your previous usage, as well as order habits. This comparison allows Bohesse to identify possible fraud patterns in order to prevent fraud and/or identity theft by comparing patterns.
Following registration and order completion, your name and addresses as given in the profile are automatically transmitted to external credit agencies. This serves to ensure that our buyers are actually registered and can be reached at the disclosed addresses.
Typical indicators which, and usually in combination, may increase the probability of attempted fraud include:
– Your delivery address was changed shortly before the submission of the order and/or is in a region with increased fraud risk.
– Your order is particularly large and/or includes products that are subject to particularly high demand at present and/or are carried out at an unusual time for your region (e.g. night time).
– The payment methods invoice or direct debit are used for the order.
– There were suspicious login attempts on your account before the order was submitted. This pattern suggests automation.
– Your customer account is accessed and/or used from a suspicious IP address.
– Your customer account is accessed and/or used by an unknown or suspicious device.
If our security systems suspect attempted fraud and/or increased risk of fraud, the relevant procedure will be investigated manually. Appropriate preventative measures will be taken in view of the risk of fraud, for example, temporary blocking the customer’s account and/or restriction of payment methods offered.
Legal basis:
If your data is processed to prevent fraud at your expense, the legal basis is Article 6 (1) b GDPR. This processing of your data otherwise occurs on the basis of Article 6 (1) f GDPR, based on our legitimate interest and that of other Bohesse users and/or customers in the identification and prevention of fraud and/or clarification of criminal offences.
2.5 Choice of Payment Methods
Before you are presented with the payment methods available for purchase, Bohesse will carry out a risk assessment. Information we use to carry out our risk assessment:
– Your previously collected purchase data
– Payment details
– Creditworthiness data
– Data on your previous payment behavior
– Your profile information, such as your full name, delivery and billing address, email address, DOB, etc.
The assessment will be carried out automatically, using statistically justified estimates of the default risk in relation to the payment methods we offer. Within the framework of the risk assessment, Bohesse automatically transmits your data to external credit agencies to receive general information from these on the evaluation of the payment-specific default risk (e.g. on whether your address is plausible and up-to-date) including, in individual cases, creditworthiness data, perhaps on open invoices and circumstances directly resulting in a risk of payment default (e.g. deferral due to inability to pay). The type of specific creditworthiness data that is taken into account in the course of the risk assessment may vary from country to country.
The default risk is assessed separately for each payment method, in the form of an estimate. In case of the risk assessment yielding a positive result, Bohesse can offer all the payment methods generally offered. Otherwise, Bohesse will only offer particular payment methods. Factors that may influence the availability of payment methods include but are not limited to:
– The combination of name and address could not be found. This may also be a result of typing errors, change of residence, marriage, etc.
– You have provided a delivery address, packing station and/or company address which differs from the billing address.
– There are still open claims against you.
– There have been payment disruptions with particular payment methods in the past.
The risk assessment, however, does not mean that you will not be offered any payment methods. If you are not in agreement with the payment methods offered, you can inform us of this in writing an email to info AT bohesse.com or by filling out our contact form. Bohesse will then check the decision again, taking your viewpoint into account.
Legal basis:
If you have given consent to the processing of your data as described above for the choice of payment methods, the legal basis is Article 6 (1) a GDPR (Consent). Otherwise, the legal basis is Article 6 (1) f DGPR, based on our legitimate interest in avoiding default risks.
2.6 Credit Checks
In addition to the Risk Assessment (see section 2.5 Choice of Payment Methods), Bohesse processes your data before showing you the payment methods that are available for you to purchase from us, in the course of an automated credit check.
This credit check serves to prevent payment defaults, as well as to ensure our security, as it allows us to recognize attempted fraud and/or other offences.
Along with data that is already in Bohesse’s possession, creditworthiness data from external credit agencies in the form of score values is also used.
Score values are statistically justified estimates of the future risk of a person defaulting and are represented as a numerical value, such as percentage. Data that is usually transmitted as a requirement for a credit check is, for example, your full name and your address. Credit agencies use this data to correspondingly assess your creditworthiness on the basis of mathematical-statistical procedures.
Depending on the results of the credit check, i.e. whether it is positive or negative, we will show you appropriate payment methods which are available to you to use in order to complete your purchase.
If you do not agree with this, you can inform us in written by sending an email to info AT bohesse.com or by filling out our contact form.
Legal basis:
The legal basis for the credit check described above is Article 6 (1) b GDPR, because it is necessary for the execution of necessary pre-contractual measures. Otherwise, the processing of your data occurs on the basis of Article 6 (1) f GDPR, based on our legitimate interest and that of other users in the avoidance of payment defaults, identification and/or prevention of fraud and/or clarification of possible criminal offences.
2.7 Data analysis, Advertising and Market Research
Within the frameworks of data analysis, we use your data for advertising and market research, in particular for the following purposes:
– The early identification of trends in the areas of fashion and online shopping.
– The execution of advertising to existing customers. For example, sending promo codes or introducing new products.
– The execution of direct marketing. For example, in the form of newsletters.
– The planning, execution and success monitoring of advertising corresponding to the interests of the target groups being addressed (personalized advertising):
– Findings as to how our Services are used (usage analysis).
– Findings on various target groups and their respective usage habits and/or shopping interests.
– Classification into various target and user groups within the framework of market research (user segmentation).
– The production of findings on demography, interests, users’ shopping and/or usage habits, as well as the marketing on these findings within the frameworks of advertising services provided to third parties.
– The marketing of the above findings within the framework of advertising services for advertising customers.
Depending on the purpose, Bohesse uses the data stored for data analysis. For example, we use summarized (aggregated), statistical, depersonalized (anonymized) profile information and/or data which can only be assigned to persons via further intermediate steps (pseudonymized profile information), as well as shopping and/or device and/or access data in order to understand and analyse purchase processes using data analysis.
This gives Bohesse anonymous and/or pseudonymized findings on our users’ general usage behavior.
Bohesse processes your data on the basis of balancing of interests to protect our legitimate interests or those of third parties (such as advertising partners (if any) and/or dealers which participate in our partner programme (if any)).
Bohesse’s legitimate interest or that of third parties in data processing derives from the relevant purposes and is, unless otherwise indicated, of a competitive and economic nature.
Legal basis:
If data processing for the above purposes occurs with your consent, the legal basis is Article 6 (1) a GDPR (Consent). Otherwise, this data processing occurs on the basis of Article 6 (1) f GDPR, whereby the legitimate interests are for the above purposes.
2.8 Product and Technology Development
For product and technology development, Bohesse uses summarized, pseudonymized and/or anonymized data and machine learning algorithms, which facilitate estimates, prognoses and analysis in the interest of Bohesse’s users. In relation to product and technology development, Bohesse processes data particularly for the following purposes:
– Development and improvement of personalized services and technologies for data analysis, advertising and personalized online shopping.
– Development of technologies and concepts to improve IT security, prevent fraud and improve data protection. For example, by psoudonymization, encryption and anonymization.
– Development and testing of software solutions for the optimization of necessary business and logistics processes.
Legal basis:
The legal basis for your data processing for product and technology development services is Article 6 (1) f GDPR, whereby our legitimate interests are in the above purposes.
2.9 Business Management and Optimization
Bohesse transmits and processes your data where necessary for administrative and logistical processes, as well as to optimize business processes. By doing so, Bohesse can design these in a more efficient and legally secure way, as well as to fulfill our contractual and legal obligations.
Bohesse’s data processing for business management and optimization includes, but is not limited to, the following purposes:
– Execution and improvement of customer services.
– Prevention and clarification of criminal offences.
– Guaranteeing the security and operability of our IT systems.
Legal basis:
The legal basis for data processing for business management and optimization is Article 6 (1) f GDPR, whereby our legitimate interests are in the above purposes. Where Bohesse processes your data on the basis of legal specifications, for example retention obligations and money laundering tests under tax law, the legal basis is Article 6 (1) c GDPR.
2.10 On the Basis of Your Consent
If you have given Bohesse.com your consent for the processing of your personal data, your consent is the primary basis of our data processing. The type of the data we process on the basis of your consent, depends on the purpose of your consent.
General purposes include:
– Subscription to our newsletter.
– Credit check execution.
– Data transmission to third parties or countries outside EU.
2.11 Other Purposes
If data protection laws allow it, Bohesse.com can use your data for new purposes. These new purposes may include data analysis and/or developing new services and content without your prior consent.
It is a prerequisite for this that these new purposes, which the data is to be used for, were not fixed or foreseeable when the relevant data was collected and the new purposes are compatible with the purposes for which the relevant data was originally collected. For example, new developments in the legal or technical sphere and new business models and services may lead to new processing purposes.
3. Personalized Services
Bohesse’s top priority is development and provision of personalized functionalities, as well as services.
Bohesse offers its customers an individual shopping experience, as well as a range tailored to individual interests. Data processing for service personalization purposes is an integral part of Bohesse service.
3.1 What are Personalized Services?
Personalized services allow Bohesse to offer you better, as well as more practical and secure services.
On this basis, we can offer our customers more relevant content, corresponding to their needs and interests. Of course, this doesn’t exclude other content.
Personalization allows everyone to see the relevant content more quickly. On other occasions, we present the content specially to our customers. For example, in the form of individual product recommendation.
3.2 Why do I Need a User Account?
Most of Bohesse’s personalized services require our customers to set up a user account so that we can save all your collected data at a central location.
3.3 Which Data is Saved on my User Account?
The data Bohesse collects on its customers is saved on users account, along with customer IDs.
Customer IDs are randomly generated and do not contain any personal data. Customer data is associated with the customer ID, in order to link everyone to their customer accounts.
Customer ID also functions as a pseudonym.
3.4 Which Data is Used for Personalization?
Personalized content is usually selected on the basis of all data stored on your user account.
If device and access data are used which are not saved on your user account, then these are only pseudonymized for the relevant personalization purposes. For example, in connection with your customer ID, but not in connection with your name or other directly identifying profile data.
Data which is NOT used for personalization:
– Creditworthiness data.
3.5 User Options
Most of the data we have stored on you, you can view at any given moment on your user account.
If required, you can also edit and/or alter this data on your account and influence personalization, such as providing your preferences.

If it is available and activated on your device, we also collect a device-specific ID number. These device IDs are issued by the manufacturers of your operating systems (for example, Android or Apple) and can be read by this Site and applications, as well as used to present content on the basis of your usage habits.
If you do not want to use this, you can deactivate it at any given moment in your devices’ browser settings or system settings.
Bohesse sets up password-protected personal access for users who register for a user account or another service.
If you do not log out after logging in with your login details, most services automatically keep you logged in. Depending on the service type, either a cookie or a similar technology is used for this function.
This function also allows you to use a part of Bohesse services, without the need to log in each time. We may also carry out the so-called A/B testing in the course of usage analysis.
A/B tests are a special kind of usage analysis. Also known as split testing, A/B testing is an approach to comparing two versions of a website or application in order to find out which version performs better, or is more popular or lets our users find their desired content quicker.

However, Bohesse cannot guarantee that some advertising partners and/or websites and applications in connection with third-party plugins we use on our Bohesse site will not use your data for personalized advertising on other providers’ websites and apps.
6.1 Advertising Formats and Channels
Bohesse and our advertising partners use advertising formats within the framework of on-site optimization, ads on social media platforms and/or Bohesse newsletters.
Bohesse does not engage in selling of personal data. When and if any of our advertising partners book an advertising format, they do not receive any data which could be used to contact and/or identify you.
